Question by E: Got served with capital one credit card debt lawsuit but i changed my name?
I was not home but my brother got served with my lawsuit for a 2,500 capital one bank credit card debt. But i changed my name so the papers served have my old name.
I have not updated my social security card with the new name, should i do that then file for bankruptcy?
I have my drivers license with my new name but my s.s. card has my old name can i still file for bankruptcy like that?

Why would you file bankruptcy over a 00 debt? Most likely, the bankruptcy court wouldn't allow it, and to top it off, the bankruptcy attorney is going to charge you over 00 just to take your case.

Cheaper to just pay Capital One.

It really doesn’t matter if you change your name or not, you would still be accountable for the debt. As far as bankruptcy, please se that as a last result. if you own a house or any cars or any other property that me of value, you have the chance in loosing it. i don’t think 2,500 is a big enough debt to file bankruptcy. people who file bankruptcy usually are about $20,00 in debt. I know it may seem like the simple way out but bankruptcy stays on your credit report for a very long time not to mention that you have to meet standards and qualify as someone needing to file bankruptcy.

Does not matter. The Social Security Number does not change. Too late to file for bankruptcy because capital one will get a judicial judgment against you before your bankruptcy is in effect.
